H. Marshall and Company, Incorporated warrants each effect to be free
from defects, in material and workmanship, for the life of the ownership of
the individual named in the registration section of this warranty (hereinafter
known as the registered owner). This
warranty does not extend to any person or persons other than the registered
owner. H. Marshall and Company, Incorporated's obligation under this warranty is limited to replacement or repair
of any defective part or parts thereof, free of charge. This warranty shall not
apply to (1) damage or loss in transit, (2) wear due to normal use and age, or
(3) damage caused by misuse, abuse, negligence or accident.
H. Marshall and Company, Incorporated does not authorize any person or
persons not expressly authorized in writing to assume any liability on behalf of
H. Marshall and Company, Incorporated in connection with the sale, use, repair
or alteration of its products or parts. This
warranty shall not apply to any H. Marshall and Company, Incorporated product
which shall have been sold, repaired or altered by any person or persons not
expressly authorized in writing to do so by H. Marshall and Company,
Incorporated.
this warranty is in lieu of
all other warranties and representations, express or implied, and all other
obligations or liabilities on the part of h. marshall and company, incorporated.
there are no other warranties except as stated herein.
after the period of expressed warranty as set forth herein, there are no
express or implied warranties, and those include those of merchantability and
fitness for a particular purpose. the
repair or replacement of any warranted part or product is h. marshall and
company, incorporated's only obligation under this warranty.
h. marshall and company, incorporated, its authorized dealers of
agents, shall not be responsible, or in any way be liable, for any special or
consequential damages for breach of any expressed of implied warranty, resulting
from any failure, defect or malfunction of its products.
some states do not allow exclusions or limitations on special or
consequential damages or on how long an implied warranty lasts, so these
limitations may not apply to the registered owner.
the registered owner may also have other rights which vary from state to
state. this warranty shall not be applicable to the extent that any
provision of this warranty is prohibited by any federal, state or municipal law
which cannot be preempted.
It is the registered owner's responsibility to return the defective
product or part to our factory at their expense, unless otherwise agreed upon.
When any product or part is being returned for repair, whether under
warranty or not, enclose a written explanation of the nature of the problem, and
ship the product or part to:
